A new mechanism for pre-trial appeal of decisions to suspend state registration of rights to real estate has come into force in Russia.

What is pre-trial appeal? Pre-trial appeal is a process that allows citizens and legal entities to challenge decisions of government agencies without having to go to court.

How does the new mechanism work?

To appeal decisions to suspend the registration of rights to real estate, there are two appeal commissions. Applicants can send their appeals to one of them depending on the type of property:

1. Central Appeal Commission — considers cases concerning objects that are enterprises as a property complex, or real estate located on the territory of more than one cadastral district. Examples of such facilities include railways, gas pipelines and other infrastructure facilities.

2. Regional appeal commissions — accept applications for all other real estate objects, such as premises, capital construction projects and land plots.

Application procedure

An application for appeal must be filed within 15 working days from the date of receipt of the notice of suspension of state registration. More detailed information about the operating procedures of appeal commissions and the necessary documents can be found on the Rosreestr website.

The decision to approve or reject the application will be made within no more than 15 working days from the date of its registration. The result will be sent to the applicant.
