Amendments again: second-hand auto parts in OSAGO are in the focus of legislators' attention

RSA supports the proposal of a number of committees of the State Duma on the need to include in the strategy for the development of the automotive industry the task of creating an industrial sector for the industrial recovery of used components. The absence of such an industry sector makes the possibility of transport operation in Russia dependent on the supply of spare parts from abroad. Passenger and cargo transportation, which, in particular, the supply of Russian regions with consumer goods depends on such dependence: difficulties with timely repairs due to lack of spare parts can affect millions of trucks and almost 1 million buses. Difficulties are also experienced by ordinary car owners. Over the last months of 2022, the share of repairs in OSAGO has decreased to 5%, including due to a shortage of components. Car owners who repair their cars themselves also face shortages of parts and long delivery times. The creation of a production facility engaged in the restoration of used components will, in the foreseeable future, significantly reduce the dependence of the Russian industry on the supply of spare parts from abroad and preserve the possibility of using vehicles by both enterprises and citizens in a normal mode.

The crisis in the auto parts market has led to a significant destabilization of not only the automotive market, but also the auto insurance market. Average OSAGO payments continue to grow, while the share of compensation in kind continues to decline. In addition, the Russian industry, passenger and cargo transportation are also heavily dependent on the auto parts market. In this regard, experts and market participants are increasingly expressing an opinion on the need to create a new segment of the automotive industry and reform the “car citizen”.

A big step towards the supply of used spare parts «on stream» was made at the end of February. Representatives of four committees of the State Duma have prepared a draft letter on this topic, which will be sent to Prime Minister Mikhail Mishustin.

The insurance community supports the proposal of representatives of the State Duma to include in the development strategy of the automotive industry the task of creating an industrial sector for the industrial recovery of used components. The crisis in the auto parts market forced representatives of auto repair shops of the automotive industry and insurers to urgently develop possible solutions to the problem. Work has been and is being done to establish parallel imports, however, the supply chains are still unstable and significantly stretched in time, which prevents the full replenishment of the missing parts in the Russian market.

The new strategy for the automotive industry, which was developed in December by the government, includes a separate item on the creation of an industrial sector for the restoration of spare parts. This is important, since new spare parts for complex units are not always available at the moment. Moreover, this problem concerns not only OSAGO insurers, but also the entire transport industry, since both cargo carriers and passenger traffic carriers faced a shortage of auto parts. Difficulties with the supply of spare parts affected about 3 million trucks and 1 million buses, literally ensuring the life of the state. To solve the problem, it is necessary to build an industrial sector for the industrial restoration of auto parts, we need regulations on how to use them. The creation of a production facility engaged in the restoration of used components will, in the foreseeable future, significantly reduce the dependence of the Russian industry on the supply of spare parts from abroad and preserve the possibility of using vehicles by both enterprises and citizens in a normal mode. We hope that insurance companies will also be allowed to use certified used parts for car body repairs that do not have a safety impact. This practice is not an invention of insurers, but has long been used for right-handed and old cars by their owners in certain regions., — explains the president of the Russian Union of Motor Insurers (RSA) Evgeny Ufimtsev.

Experts also support the renewal of the auto industry and the “car citizen” in accordance with the current situation. Some talk about the need for a global restructuring of the OSAGO system, but most agree that against the background of the crisis and instability, even a temporary stop in the work of compulsory auto insurance can lead to catastrophic consequences for Russian motorists. Therefore, the initiative to create a segment for the restoration of used components and the further introduction of used spare parts for OSAGO repairs looks the most beneficial for all market participants.

The terms of the direct repair under OSAGO remained the same. Body repair, painting — the production process has not changed in any way, everything happens in the same time frame as always. But due to the fact that the delivery of spare parts can take longer (a week or two, sometimes up to a month), the service station simply cannot start restoration repairs on time, because there is nothing to repair. Another important problem that is not so often talked about is the problem of auto lawyers who earn just on extended repair terms, presenting fines to service stations and insurers for exceeding the repair deadlines allowed by OSAGO. The Union of Car Services wrote a letter to the Federation Council, one of the points of which we point out the problem— notes Ilya Plisov, member of the board of the Union of Auto Services, Deputy General Director of the EuroAvto company.

The OSAGO: Public Expert Review project reminds us that this year the OSAGO system turns 20 years old. During this time, compulsory auto insurance has proven to be a reliable social instrument providing protection, especially in situations of economic instability. A timely response to global changes in the Russian market and the updating of the automotive industry and the legislation on OSAGO in connection with them is a guarantee that the “autocitizen” will properly serve motorists and protect them from showdowns at the scene of an accident for another 20 years and even more.
