Deliberate infliction of bodily harm leading to death: a court verdict in the Crimean Shchyolkino

The Leninsky District Court of the Republic of Crimea sentenced a 48-year-old resident of the city of Shchelkino, Leninsky District, for committing two crimes.
During the judicial investigation, it was established that at the end of April 2021, the defendant and the victim drank alcohol in the defendant’s apartment and at some point the guest decided to lie down on the host’s sofa to sleep, but the defendant was outraged by this desire and he took a metal weight weighing 5 kilograms and inflicted at least 3 blows to the head, from which the latter received a bruised wound. The defendant offered to call an ambulance, but the man refused. So, after a while, the victim again came to the defendant’s room and wanted to watch TV with him, but the latter got angry and took a kitchen knife and using it as a weapon, delivered one deliberate blow to the chest area with the blade, as a result of which the man received a stab wound, from who later died— noted in the press service of the court.
At the hearing, the defendant fully admitted his guilt and repented.
The court qualified his actions as deliberate infliction of minor bodily harm that caused a short-term health disorder (paragraph “c” of Part 2 of Article 115), as well as intentional infliction of grievous bodily harm dangerous to human life, using objects used as weapons negligently entailed the death of the victim (part 4 of article 111 of the Criminal Code of the Russian Federation).
The court, having comprehensively studied the materials of the case, taking into account the circumstances of the commission of the crime, the information about the identity of the defendant, imposed a sentence of 5 years and 10 months in prison.
The verdict did not enter into force.
