Goskomregister of the Republic of Crimea: the presence of a stamp on the document on its transfer to electronic form is a condition for registering the right

The presence of a stamp on a paper document on the transfer of such a document into electronic form is a prerequisite for registering the right. This was announced by Yulia Zhiganova, Deputy Chairman of the State Committee for State Registration and Cadastre of the Republic of Crimea. After Federal Law No. 449-FZ came into force, on the basis of which Goskomregistr and MFC completely switched to digital document management , some the applicants began to object to the employees of the multifunctional centers putting a mark on paper documents about the conversion of such documents into electronic form. Due to the fact that such refusals have direct legal consequences, the Goskomregister considers it necessary to bring the following official information to the attention of citizens.

As already reported, Goskomregister specialists now work with electronic scanned images of documents that are sent to the department from the MFC. Scanned images are certified by an enhanced qualified signature of MFC specialists, are received by the registration authority via secure communication channels and have the same legal force as papers, which is also prescribed by law. Putting a mark on the sale and purchase agreement, gift or other document submitted for receiving registration and registration services is not a whim of the MFC employees, but a direct requirement of the law that everyone should comply with. If the applicant refuses to put the appropriate stamp on paper, in this case the registration authority will be forced to suspend the state registration procedure due to non-compliance of documents with the established requirements for their form and content. These requirements are established by the Government of the Russian Federation. According to the new rules, without such a stamp, registration of a right or a real estate transaction simply will not be completed. At the same time, affixing a stamp by an MFC employee will not be considered damage to documents if in the future it is necessary to use a paper original somewhere , the press service quotes Yulia Zhiganova.

According to the specialist, from 29 June 2022 of the year, absolutely all accounting and registration actions are confirmed by an extract from the Unified State Register of Real Estate.
