Goskomregister of the Republic of Crimea: when applying for registration of real estate, you need to make sure that the objects have not yet been issued according to Russian laws

Before applying for registration of real estate, citizens need to make sure that the rights to objects have not previously been formalized according to Russian laws. The recommendation was voiced by Yulia Zhiganova, Deputy Chairman of the State Committee for State Registration and Cadastre of the Republic of Crimea. According to her, cases of decisions to suspend registration actions in respect of real estate due to contradictions between declared and already registered rights have become more frequent in the department. In other words, citizens are trying to register the right to property that is fully registered in accordance with the requirements of Russian law. Thus, information about the owner could be entered into the Unified State Register of Real Estate (EGRN) when the owner’s representative applied by notarized power of attorney, and then the owner himself applied for the same service. There are examples when heirs, after taking ownership, apply for registration, although notaries have successfully done this for them. Also, documents for registration of rights could initially be submitted by local governments in the manner prescribed by Federal Law No. 93-FZ.

Let me clarify that in this case we are not talking about reissuing Ukrainian documents to Russian ones. Rights that arose in the Ukrainian or Soviet period can and should be registered. The catch is different: citizens whose entry on the right is entered in the USRN re-submit an application, and the committee’s specialists are required to decide on the suspension of registration, and subsequently on refusal. It turns out that people re-submit documents in vain, since everything has been in order for them for a long time. But at the Committee, these suspensions are included in the overall statistics, which we are also not interested in, because we have specific tasks to reduce them. In such cases, in order to avoid misunderstandings, we recommend that Crimeans first check whether the right is registered in the USRN or not. You can use the Internet services «Public Cadastral Map» or «Reference information on real estate objects online» on the Rosreestr portal. But the most reliable is to order an extract from the USRN about the main characteristics and registered rights. If the ownership of a house or land is not formalized in accordance with the laws of the Russian Federation, then there is no such entry in the register and the applicant will be given a notice about the absence of the requested information in the USRN , — the press service quotes Yulia Zhiganova.
