The notary has connected to the civil registry office’s broadcast mailing list. This was reported to RG by the Federal Notary Chamber. Experts emphasize: constant updating of data in the Unified Notary Information System ensures that the verification of powers of attorney through the notary service, which occurs in real time, takes into account current data. In other words, it will be clear almost immediately that the power of attorney is no longer valid, since the person who issued it is no longer alive.
Checking powers of attorney through a public notary service has become even more informative. Now it displays information about the cancellation of the document due to the death of the principal— they say at the notary office. — Previously, a notary could obtain information about death from the Unified State Register of Civil Registry Offices only upon request in relation to a specific person in connection with the performance of a notarial act. Now data on the state registration of the death of citizens from the Unified State Civil Registry Office quickly enters the Unified Notary Information System. And when checking the power of attorney through a public service, the system automatically analyzes the specified information. If information about the death of the principal has already been entered into the registry office register, it will also appear when checking the power of attorney. This will make it possible to promptly stop the illegal use of documents issued by principals who have already died.
Unscrupulous attorneys will not be able to conduct a transaction, sell property, withdraw money from an account, or perform other legally significant actions on behalf of a deceased person. The new function is available when checking powers of attorney issued after December 29, 2020.
As before, when checking any power of attorney through the notary register, the system will show whether a document with the specified details exists, who certified it and when, and whether there were orders from the principal to cancel the document, — they say at the notary office. — Anyone can use the service around the clock and for free. The whole process takes just a few seconds. Thus, in just eight months of this year, citizens and business representatives used the service more than 2 million times.
Data in the service is updated daily.
It is important that the notary’s EIS receives not only initial information about the state registration of death, but also all official changes that are made to this act recordsay representatives of the notary office. — This may involve correcting typos or clarifying data, such as last name or date of birth. It may also be the cancellation of a death record. If this happens, the power of attorney issued by that person is shown as valid again.
The Russian notary office is actively introducing modern digital tools and creating reliable and technologically advanced services aimed at protecting the rights of citizens and businesses, experts emphasize. The implementation of a new function for the power of attorney verification service, which is a unique technological solution for the Russian notary office, is another step in this direction. At the same time, digital notary projects are created, supported and developed by the Federal Notary Chamber exclusively at the expense of the notary itself.
An interesting fact: as an analysis of foreign practice shows, similar open services that take into account the death of the principal when checking a power of attorney do not currently exist.
