Important: the amount of the performance fee has been increased, and the procedure for collecting it has been clarified.

An amendment has been made to the Federal Law “On Enforcement Proceedings”, according to which the enforcement fee is set at 12% of the amount to be recovered or the value of the recovered property (previously — 7%).

The minimum amount of the fee has been doubled — 2 thousand rubles from an individual (including individual entrepreneurs) and 20 thousand rubles from a debtor organization.

In case of non-execution of an enforcement document of a non-property nature, the enforcement fee is also doubled — to 10 thousand and 100 thousand rubles, respectively.

In addition, a provision has been introduced establishing the procedure for collecting and the amount of the fee in the event of failure by the debtor to fulfill a property-related executive document, and the procedure for distributing funds received into the deposit account of the bailiff service in the execution of property-related claims has also been clarified.
