The Bakhchisarai District Court of the Republic of Crimea sentenced an imaginary entrepreneur for fraudulent activities on an especially large scale. The defendant was sentenced to 3 years in prison to be served in a penal colony of general regime with a fine of 100 000 rubles.
During the consideration of criminal cases, it was established that since 2019 a cafe-dining room has been operating in the city of Bakhchisaray. All permits for doing business were issued to a local entrepreneur. However, in fact, the defendant, who is the entrepreneur’s brother, was engaged in doing business, together with his acquaintance in equal shares. At the beginning of September 2020, a man offered his old acquaintance to sell his partner’s share in the business, without informing the latter of his intentions , — the details of the case were announced in the press — department service.
The swindler convinced the victim that he was actually dealing with the affairs of the dining room, and if the transaction took place through his mediation, then the partner’s share in the cafe would become a better purchase for the victim than directly through a partner. The defendant acted without the knowledge and consent of the partner, while having no legal grounds for making such a transaction. The attacker undertook to transfer the money to his partner, knowingly not intending to do so, nor intending to take any action to alienate the share of the partner’s business in favor of the victim.
The man, having misled the buyer and acting with the aim of stealing other people’s property, received money for the sale of a share of the business in the amount of 2019 rubles, which he disposed of at his own discretion.
At the hearing, the defendant pleaded not guilty.
Based on the evidence collected and examined at the hearing, the court concluded that the defendant was guilty and that his actions were qualified under Art. part 4 of the Criminal Code of the Russian Federation, as fraud, that is, theft of another’s property by deceit, committed on an especially large scale.
No civil action has been filed.
