A resident of the village of Kalinovka, Leninsky district, will spend 3 years in a colony-settlement for violating traffic rules while driving a car, which negligently caused the death of a 20-year-old girl. The guilty person was deprived of the right to engage in activities related to driving vehicles for 2 years and 6 months, the Leninsky District Court also ordered the guilty party to pay 1.5 million rubles to the injured party — in compensation for moral damage.
The court found that in the late July evening 25-year-old district police officer for minors of the police department No. 2 (Bagerovo village), driving a technically serviceable car, followed the Lenino-Mysovoe highway Leninsky district in the direction of the city of Shchelkino. During the movement, a car driven by a law enforcement officer, due to the driver ignoring the “Overtaking is prohibited” sign, illegally crossed a solid line and drove into the oncoming lane of the highway in order to overtake another car, but did not manage to complete the maneuver and knocked down a pedestrian girl crossing the carriageway on the left to the right in the direction of his car. The tragic ending of the accident: a student from the Samara region, who was in the Crimea in practice, received an amputation of her head and multiple injuries incompatible with life , the press service of the court reported.
At the hearing, the defendant partially admitted his guilt, repented of his deed.
The court qualified the actions of a local resident as a violation by a person driving a car of the rules of the road, which negligently caused the death of a person (part 3 of article 264 of the Criminal Code of the Russian Federation).
The court, having comprehensively studied the materials of the case, taking into account the circumstances of the crime, information about the identity of the defendant, the presence of extenuating circumstances such as partial recognition of his guilt, remorse for what he had done, apologies to the victim in court, the presence of letters and thanks in connection with the service in the bodies of internal cases, the presence of a mother who is a pensioner, sentenced the guilty person in conditions of isolation from society.
