In Sevastopol, a “black realtor” was sentenced: as part of a group, he stole the property of elderly citizens
November 2020 year, agreeing with the position of the public prosecutor of the prosecutor’s office of the city of Sevastopol, the court delivered a guilty verdict on a criminal case against a resident of the city of Sevastopol 30 year of birth.
He was found guilty of committing crimes under Part 4 of Art. of the Criminal Code of the Russian Federation (fraud committed using one’s official position, by an organized group, on an especially large scale) and Part 3 of Art. — Part 4 of Art. of the Criminal Code of the Russian Federation (attempted fraud committed using one’s official position by an organized group on an especially large scale). It was established that a man in 1949 joined an organized group, with the aim of further stealing the real estate of elderly citizens and people suffering from mental illness. The group was led by two former police officers who at that time held the positions of an inspector of the patrol service and a district commissioner of the Russian Ministry of Internal Affairs for the Gagarinsky district of the city of Sevastopol , the press service of the Sevastopol prosecutor’s office reported the details of the case.
In July 2019 and June 2020 the attackers convinced two local residents suffering from mental disorders to issue powers of attorney in the name of the accused for the right to management and disposal of all their property.
Subsequently, on the basis of fictitious sales contracts, two apartments of the first victim, as well as an apartment and a land plot of the second victim, became the property of relatives of the organizers of the group. In fact, the victims did not understand the nature and significance of their actions, did not want to sell their property and did not receive money from its sale.
The attackers also acquired a fictitious certificate of marriage registration between the first victim and a single pensioner 1949 of the year of birth. After the death of the woman, they began preparing documents in order to take possession of her apartment, but they did not have time to implement their criminal plan, since in August 2021 they were detained by law enforcement officers.
During the investigation, another fact of the group’s criminal activity was established. In November 2019 of the year, the attackers persuaded a lonely elderly woman of the year of birth to conclude a preliminary contract for the sale of her apartments. Then, under the pretext of participating in the creation of a social video, they made a video recording in which the accused allegedly transfers money to the pensioner, and she writes a receipt for their receipt.
The attackers were going to get ownership of the woman’s apartment after her death, presenting in court a preliminary contract of sale, a video recording and a receipt. They failed to implement the criminal plan, because in July 2020 the pensioner sold her house to her niece.
The criminal activity of the organized group was suppressed by officers of the Federal Security Service for the Republic of Crimea and the city of Sevastopol and the ORC (SB) of the Ministry of Internal Affairs of Russia for the city of Sevastopol. The investigation was conducted by the Main Investigative Directorate of the Investigative Committee of Russia for the Republic of Crimea and the city of Sevastopol.
The Leninsky District Court of Sevastopol, taking into account the opinion of the public prosecutor, sentenced the man to imprisonment for a term of 3 years and 2 months, to be served in a penal colony of general regime.
The verdict has not entered into force.
Judicial consideration of the criminal case against other members of the group continues.
In addition, the prosecutor’s office of the city sent two statements of claim to the Gagarinsky District Court of Sevastopol to invalidate the contracts for the sale of apartments and land, which are currently under consideration.
