The duty unit of the Ministry of Internal Affairs of Russia for the Chernomorsky District received applications with a request to take action against unknown persons who are distributing advertisements for narcotic drugs on the facade of the building.
As a result of operational-search activities, employees of the drug control group of the Ministry of Internal Affairs of Russia for the Chernomorsky District identified the persons who committed this administrative offense. They turned out to be 16 and 19 — summer residents of the city of Sevastopol. They confessed to their deed and explained that on the night of 12 on July, inscriptions were applied promoting the distribution of drugs. The police issued a decision on an administrative offense under Part 1 of Art. 6. Code of Administrative Offenses of the Russian Federation (propaganda of narcotic drugs, psychotropic substances or their precursors, plants containing narcotic drugs or psychotropic substances or their precursors, and parts thereof containing narcotic drugs or psychotropic substances or their precursors, new potentially dangerous psychoactive substances) , — told the press -service of the Ministry of Internal Affairs of Russia in the Crimea.
The sanction of the article provides for the imposition of an administrative fine on citizens in the amount of 4,000 to 5,000 rubles.
Drawing various kinds of inscriptions and drawings on the walls of houses refers to manifestations of hooliganism and vandalism. Any writing on the wall is illegal unless permission has been obtained from the owner.
Administrative responsibility (upon reaching the age of 16 years)
According to article 7.17 of the Code of Administrative Offenses of the Russian Federation — the destruction or damage to someone else’s property, if these actions did not cause significant damage, entails the imposition an administrative fine in the amount of three hundred to five hundred rubles.
In accordance with Part 1 of Article 20.1 of the Code of Administrative Offenses of the Russian Federation — petty hooliganism, that is, a violation of public order, expressing clear disrespect for society, accompanied by the destruction or damage to other people’s property, entails the imposition of an administrative fine in the amount of five hundred to one thousand rubles or administrative arrest for up to fifteen days.
Criminal liability (upon reaching the age 14 years)
According to Part 1 of Art. 16 of the Criminal Code of the Russian Federation — vandalism, that is, desecration of buildings or other structures, damage to property on public transport or in other public places, shall be punishable by a fine in the amount of up to 40 thousand roubles, or in the amount of the wage or salary, or any other income of the convicted person for a period of up to three months, or by compulsory works for a term of up to 360 hours, or by corrective labor for a term of up to one year, or by arrest for up to three months.
It should also be noted that for minors who have committed the above crimes or administrative , but not reaching 16 or 14 years, respectively, by virtue of paragraph 1 of Article 1073 of the Civil Code of the Russian Federation, for the harm caused by a minor who has not reached the age of bringing to criminal or administrative responsibility, his parents are responsible (adopt ate) or guardians who will also bear administrative responsibility in accordance with the provisions of Part 1 of Art. 5. 35 Code of Administrative Offenses of the Russian Federation — Failure to perform or improper performance of duties for education, entails a warning or a fine in the amount of one hundred to five hundred rubles «in the form of a warning or an administrative fine in the amount of one hundred to five hundred rubles ,» the press service of the department emphasizes.
