Likbez: driver's license is not considered an identity document

The verdict that a driver’s license, despite the presence of a photo, is not considered an identity document, in review of jurisprudence ruled by the Supreme Court of the Russian Federation.

As specified in the document, a certain driver was fined for violating the rules for transporting dangerous goods. The man was transporting commercial oil without a civil passport. The driver presented the driver’s license to the inspector, but it was not enough.

The employee issued a traffic police fine to the motorist, but the district court overturned the decision without seeing the composition of the violation. The regional court and cassation also supported the decision. The judge referred to the fact that there is no information in the European Agreement on the International Carriage of Dangerous Goods by Road that a passport is the only identity card.

However, the Supreme Court of the Russian Federation decided to punish the man, since in the regulations rights are not considered an identity document. A driver’s license confirms the right to drive a vehicle (clause 4, article 25 of the Federal Law «On Road Safety»), and identity can only be verified with a civil passport. That is, the driver must have both a passport and a driver’s license.

By the way, it was not possible to prosecute the driver who transported the oil due to the expiration of the statute of limitations.
