Official: it will be easier for people to legalize land rights

It will become easier to legalize rights to land plots. A bill eliminating a number of contradictions in legislation relating to land rights has been submitted to the State Duma, as follows from the database of the lower house of parliament.

If the draft law is approved, it will be easier for people to legalize their rights to plots that they actually own and use. Many citizens have been using land plots received during the Soviet period for decades, having formalized the right of lifelong ownership or indefinite use, noted one of the authors of the document, chairman of the State Duma Committee on Property, Land and Property Relations Sergei Gavrilov. However, they cannot transfer the plots into ownership, as they receive refusals due to formal restrictions.

According to the current Land Code, you can receive land for free only once. This restriction was introduced to prevent people from trying to repeatedly obtain land from the state. At the same time, the legislation describes situations when a person uses a plot of land and wants to register its ownership, and it does not specify “one time”. However, officials often refuse citizens, citing a general rule.

The bill eliminates this contradiction. The document explicitly states that the “one time” rule does not apply when registering the right to a used plot. The head of the committee emphasized that in such cases a person does not receive a new allotment, but secures his rights to the land that actually belongs to him.

If the amendments are adopted, the registration of land that is actually in use will not depend on whether a person has exercised the right to receive another plot of land free of charge. This clarification will help protect the rights of pensioners, gardeners, heirs of plot owners, and workers of former state farms. Often these people cannot legalize their land ownership for years.
