Rosreestr clarified the application of the provisions of paragraph 49 of the Procedure for providing information contained in the Unified State Register of Real Estate
In accordance with paragraph 49 of Procedure N P/0149, documents submitted together with a request for information from the Unified State Register of Real Estate in electronic form must be presented in the form of electronic documents (electronic images of documents), certified by an enhanced qualified electronic signature (hereinafter referred to as the ECES) of the person who signed the document, an authorized person of the body that issued the document, or the ECES of a notary.
The specified provision of paragraph 49 of Procedure N P/0149 requires a notary to perform a notarial act to certify the equivalence of an electronic document to a document on paper in accordance with Article 103.8 of the Fundamentals of the Legislation of the Russian Federation on Notaries dated 02/11/1993 N 4462-1 (hereinafter referred to as the Fundamentals).
Certification of the equivalence of an electronic document to a document on paper means confirmation of the identity of the content of an electronic document produced by a notary with the content of a document presented to a notary on paper. An electronic document produced by a notary has the same legal force as a document on paper, the equivalence of which is certified by a notary (Part 1 of Article 103.8 of the Fundamentals).
According to Part 3 of Article 103.8 of the Fundamentals, the production of an electronic document to certify its equivalence to a document on paper is carried out by a notary by making an electronic image of the document on paper and signing it with a qualified electronic signature of the notary.
It is not allowed to certify that an electronic document is equivalent to a document on paper in relation to transactions concluded in simple written form, as well as documents identifying the applicant (Part 2 of Article 103.8 of the Fundamentals).
