Since September 2025, the life of gardeners in Russia has undergone significant changes. A number of new legislative acts, in particular, the Federal Law of 353-FZ, made adjustments to the rules for the creation, functioning and management of horticultural non-profit partnerships (SNT), as well as the rights and obligations of owners of garden plots. We will analyze the key points that have affected everyone who owns land plots.

The first and, perhaps, the most important change is the ban on the creation of new SNT on agricultural lands, as well as in the territories of settlements, if urban planning regulations do not provide for the possibility of gardening and gardening for their own needs. This means that the dreams of creating SNT on the former collective farm field, where rye has recently swayed, can only remain dreams. What does this mean in practice? If you are offered to buy a land plot of agricultural purposes and promise the prospect of creating SNT, be extremely careful. Carefully study the urban planning plans, land use and development (PZZ) of a particular territory. Otherwise, you risk acquiring a site where it will be impossible to legally create SNT.

The unity of the fate of the site and buildings: what is it? The law clearly defines the principle of the unity of the fate of the land and capital buildings on it. This means that now it is impossible to sell a land plot without capital buildings located on it, and vice versa. What is considered capital building? The law gives a clear definition: these are sheds, baths, greenhouses (having a foundation), awnings, summer kitchens, cellars, as well as wells. It is important to understand that only those structures that are firmly related to the ground and cannot be transferred without significant damage include capital buildings.

Section of household buildings: Now it is forbidden! Another important innovation is a ban on the section of farm buildings and garages into several separate real estate objects. This is a logical continuation of the principle of the unity of the fate of the site and buildings. Previously, for example, it was possible to divide the shed into two independent objects and sell them to different owners of neighboring sections. Now such an opportunity is excluded.
