Sevastopol police: voluntary surrender of weapons exempts you from criminal liability
For illegal possession of weapons and ammunition, Part 1 of Art. 222 of the Criminal Code of the Russian Federation establishes criminal liability, the maximum penalty for which is up to 5 years in prison. If these acts are committed by a group of persons by prior conspiracy, the punishment is increased — up to 10 years in prison.
According to Art. 22 of the Federal Law “On Weapons”, citizens are obliged to immediately hand over to the police any weapons found or transferred to them that are not registered in their name.
To legalize such actions, you must contact the nearest territorial police department or call “102”. When handing over a weapon, a protocol is drawn up indicating the basis for “voluntary surrender”, and an explanation is taken from the citizen about the origin of the weapon.
It is important to know: in all cases of voluntary surrender of weapons, ammunition, explosives or explosive devices, a citizen is exempt from criminal liability unless his actions constitute another crime. At the same time, the seizure of objects during arrest or during operational-search activities is not recognized as voluntary surrender.
