The Crimean prosecutor's office deals with an illegal six-story building in the resort Nikolaevka

The prosecutor’s office of the Simferopol region conducted an audit of compliance with the requirements of the legislation in the field of urban planning. The fact of illegal cadastral registration of a capital construction object in the village of Nikolaevka was revealed.
It was established that the cadastral engineer entered in the technical plan of the object inaccurate information regarding the number of storeys of the building, displaying three floors instead of six. On the basis of this document, the ownership of the specified building was illegally registered, despite the fact that the type of permitted use of land plots (for individual housing construction) does not imply multi-storey buildings— reported the details in the supervisory department.
The materials of the check were sent to the investigating authority for the initiation of criminal cases under Part 1 of Art. 170.2 of the Criminal Code of the Russian Federation (introduction by a cadastral engineer of knowingly false information into the technical plan, if these acts caused major damage to the state), part 5 of Art. 327 of the Criminal Code of the Russian Federation (use of a knowingly false document). The course and results of the procedural check are controlled by the district prosecutor’s office.
At present, the court has made a decision to recognize the specified capital construction object as an unauthorized construction and to oblige the owner to bring it into line with the parameters of the permitted construction.
