It was proposed to strengthen the guarantees of the child’s rights to receive alimony by legislating that their amount cannot be lower than the subsistence minimum, as well as introducing a compensation mechanism in case the amount of alimony collected is below this minimum. On March 13, the draft law was submitted to the State Duma by deputies of the “A Just Russia” faction, led by Sergei Mironov.
The bill amends a number of articles of the Family Code of the Russian Federation.
The minimum amount of alimony collected from parents… cannot be lower than the subsistence level for children established in the constituent entity of the Russian Federation at the place of residence of the person receiving alimonysays the text of the document.
In addition, the bill provides for a compensation mechanism in the event that the actual collection in a particular month is below the established minimum for objective reasons, such as the payer’s lack of official income.
At the same time, state compensation does not cancel the parent’s obligation to support the child: the amounts paid will be subsequently recovered from the payer into the federal budget with the accrual of interest for the use of someone else’s money.
According to the authors, the proposed changes are designed to create more stable guarantees for the child and reduce the dependence of the level of his support on the instability of collection.
As Parlamentskaya Gazeta wrote, in early March, a bill was introduced to the State Duma proposing to prohibit the registration of real estate and vehicles, as well as the opening of bank accounts for persistent alimony defaulters included in the FSSP register.
