The Office of the Federal Service for State Registration, Cadastre and Cartography for the Republic of Crimea explained the procedure for returning excessively (erroneously) paid state fees for real estate registration.
The law provides several grounds for the return of funds. Let’s imagine that the applicant has paid the state fee, but the application for state registration of rights has not been submitted and for some reason the citizen did not need to apply for the service. In this situation, the payment amount will be refunded in full. In addition, the fee is retained if the submitted documents were not accepted for processing and were returned without consideration (i.e., the same receipt can be provided upon re-application). Half of the paid state duty will be returned if one or all participants in the transaction submit an application to terminate registration actions at the initiative of the applicant. Finally, if you pay a larger amount than is established by law, the payer will receive back only the amount of the overpayment itself. If a decision is made to refuse state registration, the state duty “burns out.”
The traditional way of submitting documents for a refund of state fees for registration and registration actions or fees for providing information from the Unified State Register of Real Estate is to fill out the appropriate application and submit it by mail or by hand to the Rosreestr Office for the Republic of Crimea at the address: 295001, Republic of Crimea, Simferopol, st. Krylova, 162. An application for the return of excessively (erroneously) paid funds can be filled out on site at the specified address or downloaded on the department’s website (www.rosreestr.gov.ru) in the “Republic of Crimea” section by selecting subsections “Public services and functions”/Details of payment documents”. A photocopy (original) of the payment receipt must be attached to the application. It is worth noting that if payment for an extract from the Unified State Register was made in cash, then in order to receive a refund you will need to attach the original receipt. A detailed list of documents that must be attached to the refund application is also posted on the website (https://clck.ru/3RMo9o).
A refund request can also be submitted electronically.
To do this, you need to log in to the copyright holder’s personal account on the Rosreestr website using your State Services credentials. Next, in the “My Services/Other” section, select the “Refund of fees and state duties” service. The user will have to enter information about the applicant and the payment to be returned, and attach a payment document in pdf, zip or xml format.
