The State Register of the Republic of Crimea spoke about the conditions for registering transactions with the participation of foreigners

The State Committee for State Registration and Cadastre of the Republic of Crimea spoke about the conditions for state registration of transactions involving persons from unfriendly foreign states. Recall that in March 2022, Russia established a special procedure for registering real estate transactions involving residents of states unfriendly to the Russian Federation, as well as individuals and legal entities controlled by these countries. In accordance with such transactions began to be formalized subject to the provision of an appropriate permit from the Government Commission for Control over Foreign Investments in the Russian Federation. In order to ensure the financial stability of the country, additional conditions for such transactions were determined.
Yes, according to transactions with persons of unfriendly foreign states that simultaneously meet the following requirements are allowed. Non-residents of the Russian Federation must under the control of Russian legal entities or individuals, including if this control is exercised through foreign legal entities associated with such foreign states. At the same time, information on control over them must be disclosed to the tax authorities of the Russian Federation by Russian legal entities or individuals named in subparagraph «a» of clause 12 of the presidential decree.
The fact that a company from an unfriendly state is under control can, for example, be confirmed by a receipt from the Federal Tax Service of Russia on acceptance of a notice of controlled companies in the form of an electronic document if it is submitted via telecommunication channels or through the taxpayer’s personal account. If the document was submitted on paper directly to the tax authorities, a mark on the acceptance of the document will suffice here. The third option is a postal receipt with a description of the attachment with a mark of the postal authority (in the case of sending a document by mail). She also added that when applying for a public service, representatives of joint-stock companies are advised to independently provide extracts from the register of shareholders and extracts from the register of securities, in accordance with which information on the share of participation of hostile foreign capital will be disclosed. Representatives of limited liability companies in the State Register were advised to provide information about all founders and their citizenship.
Rosreestr also recommends developers to place documents confirming that the company is under the control of friendly countries in the Unified Housing Construction Information System (UIIS), after which they will not be additionally required to provide them, — says Olesya Kalinkina, head of the Rosreestr Office for the Republic of Crimea and Sevastopol.
