Up to 18 years of age: the State Duma committee approved raising the age for receiving child benefits
The State Duma Committee on Family Protection, Issues of Paternity, Maternity and Childhood recommended that the House of Parliament adopt in the first reading the bill of the Legislative Assembly of St. Petersburg on increasing the possibility of receiving a monthly benefit in connection with the birth and upbringing of a child until he reaches the age of 18.
They want to make changes to Federal Law No. 81-FZ “On state benefits for citizens with children.” Currently, in Russia the deadline for receiving benefits is until minors reach 17 years of age. But in accordance with paragraph 1 of Article 54 of the Family Code, a child is recognized as a person who has not reached the age of 18 years. St. Petersburg deputies draw attention to the fact that in this situation the norms of Federal Law No. 81-FZ on state benefits are not fully consistent with the norms of the Family Code.
The explanatory note states that a person who is still a child and in the care of his parents is unfairly deprived of part of the financial support guaranteed by the state. It is noted that children aged 17 to 18 years continue their studies in educational organizations and do not engage in permanent work.
Meanwhile, the Russian Government submitted a negative review of the bill. There, in particular, they noted that the adoption of the law will require the allocation of additional funds from the federal budget, but in violation of the requirements of Article 83 of the Budget Code of the Russian Federation, the sources and procedure for fulfilling expenditure obligations have not been determined. According to the financial and economic justification for the bill, its adoption will entail an increase in federal budget expenditures from 17.9 to 35.7 billion rubles. As a result, the Cabinet of Ministers noted that the document needs conceptual revision.
