2 criminal cases involving a fatal accident — what sentences were handed down by the Bakhchisarai District Court

The Bakhchisarai District Court of the Republic of Crimea considered 2 criminal cases regarding a fatal road accident. These two cases, unrelated by circumstances, have one outcome — imprisonment of the perpetrators and death due to their fault as a result of an accident.

As established by criminal case materials, one of the tragedies occurred in early June 2022. A group of young people drove around in a VAZ 21093 car at night within the boundaries of the village. Postal service of Bakhchisarai district. At some point, one of the company moved from the front passenger seat to the car door, with his body ending up outside the car. Then the driver of the vehicle lost control while driving and caused the vehicle to overturn. As a result of the accident, the specified passenger of VAZ 21093 was injured, which resulted in his death. An aggravating circumstance was that the driver was intoxicated, the press notes.

The result of these terrible events was the imprisonment of the 28-year-old driver for a period of 6 years and 3 months of imprisonment in a penal colony and the death of the 24-year-old passenger.

The court, sentencing the defendant under Part 4 of Art. 264 of the Criminal Code of the Russian Federation — violation of traffic rules by a person driving a car, resulting in the death of a person through negligence, committed by a person in a state of intoxication, also ordered the defendant to pay compensation for moral damage of 700 thousand rubles each to the parents and minor brother of the deceased.

Another case occurred within the village of Tabachnoye, Bakhchisarai district, in April 2023. The driver of a MAZ car was driving with a trailer along a section of a two-way road. A 54-year-old man, driving a vehicle, showed criminal frivolity towards ensuring road safety, drove into oncoming traffic, where he collided with a Lada Priora car moving towards him. As a result of a car collision caused by a truck driver, a 48-year-old Lada driver died at the scene of the accident.

When considering this criminal case, the court took into account all the circumstances and sentenced the perpetrator under Part 3 of Art. 264 of the Criminal Code of the Russian Federation — violation of traffic rules by a person driving a car, which through negligence resulted in the death of a person in the form of 1 year of imprisonment with serving the sentence in a penal colony.

During this trial, the son of the deceased man declared a waiver of the civil claim in connection with full compensation for the material damage and moral damage caused.

When considering these criminal cases, in court hearings, the defendants fully admitted their guilt and repented of their actions, but the outcome was the same — imprisonment.

The guilt of the defendants has been proven.

The verdicts have not entered into legal force.
