A bill on the right of residents to self -defense was submitted to the State Duma

The legislation proposed to secure the right of citizens to defend themselves from attackers who illegally entered their house. Such a bill was introduced to the State Duma. Deputies from the LDPR party proposed resolving self -defense methods for residents of apartments and houses in the legislation.

The authors of the bill believe that in such cases, people should be able to protect themselves and households, without the risk of being convicted. According to the document, with illegal invasion of home, people will be able to use any self -defense methods.

It is proposed to enter in Art. 37 of the Criminal Code of the Amendment, according to which actions aimed at protecting against encroachments with illegal penetration into the dwelling cannot be considered as excess of self -defense. According to the head of the State Duma Committee on Labor, Social Policy and Affairs of Veterans, Yaroslav Nilov, people should not find out who and for what purpose penetrated their house and understand the intentions of the criminal and how dangerous the attacker is for households.

Cabinet did not support the amendments. The government stated that such an interpretation of the self -combustion limits excessively expands the boundaries of the right to the necessary defense and does not allow to evaluate the proportionality of the defender’s actions. The actions of the defender are and are not an excess of the limits of the necessary defense, if the degree of danger of the attack is impossible due to surprise, the Cabinet emphasized.

Recall that in May 2022 the Supreme Court ruled that illegal penetration into the house poses a threat to human life, even if it is not accompanied by obvious violence. With illegal penetration into the house, people can apply self -defense measures.
