CrimeaPRESS reports:
The Krasnoperekopsky District Court of the Republic of Crimea brought to criminal responsibility a previously unconvicted 37-year-old resident of the Krasnoperekopsky district for failure by a parent to pay without good reason, in violation of a court decision, funds for the maintenance of minor children, if this act was committed repeatedly (Part 1 of Article 157 of the Criminal Code of the Russian Federation).
From the materials of the criminal case it follows that by a court decision, alimony was collected from this citizen for the maintenance of his minor daughter. During the forced execution of the above court decision, in violation of the court decision, he did not pay alimony for the maintenance of a minor child, and therefore, by the decision of the magistrate, he was brought to administrative responsibility under Part 1 of Art. 5.35.1 Code of Administrative Offences. Continuing to evade paying alimony for the maintenance of his minor daughter, he accumulated a debt in the amount of more than 286 thousand rubles. By these actions, he did not fulfill the obligation of parents to support their children established by Article 38 of the Constitution of the Russian Federation, and grossly violated the child’s rights to education, ensuring his interests, comprehensive development and respect for his human dignity— reported the press service of the court.
At the court hearing, the defendant fully admitted his guilt in committing the crime charged against him and repented of his crime.
Taking into account the mitigating and absence of aggravating circumstances, mediocre characteristics, the defendant was sentenced to correctional labor for a period of 4 months with the withholding of 5% of wages to the state.
The verdict did not enter into legal force.
