A fraudster from Bakhchisarai was sentenced for multi-million dollar theft of other people’s property through deception or breach of trust. The Bakhchisarai District Court of the Republic sentenced the perpetrator to 6 years of imprisonment in a general regime correctional colony with a fine of 500 thousand, with deprivation of the right to hold positions related to the exercise of the functions of a government representative for a period of 3 years.
The materials of the criminal case established that the criminal path of the attacker consisted of several episodes.
In August 2018, the defendant, who at that time was the head of the municipal property and housing and communal services department of the Bakhchisarai administration, promised a local resident to resolve the issue of allocating her a plot of land to locate a retail outlet. However, resolving such issues was not within the competence of the former official and he did not plan to help the entrepreneur.
For his “work,” the attacker received 350 thousand rubles from the woman, but did not fulfill his promise.
The defendant’s next case was the deception of another local resident in August 2020, from whom the fraudster defrauded 750 thousand rubles. During a chance meeting with a previously unknown man in a conversation, the swindler learned that he intended to buy a plot of land with a dilapidated house. Having quickly gained his bearings, the attacker told the man that he knew the owners of such a home and could help with the purchase of real estate. Subsequently, having misled the victim by providing false receipts and concluding an unauthorized deposit agreement for the purchase and sale of the specified real estate, the fraudster illegally took possession of funds belonging to the man in the amount of 350 thousand rubles, and then 400 thousand rubles, without fulfilling his obligations .
In addition, the victim of the scammer was a resident of the Moscow region, who in February 2019, having seen an advertisement on the Internet information and telecommunications network for the sale of two adjacent land plots in the Bakhchisarai region, decided to purchase these plots of property. Having called the phone number indicated in the advertisement, the man found out the terms of the sale that suited him and a few months later came to Crimea to complete the transaction. The seller of the plots turned out to be the defendant, who is the owner of the said property. The parties agreed on the price of the land plots at 5,650,000 rubles and, at the defendant’s suggestion, entered into a deposit agreement for the purchase and sale of the specified real estate. The victim gave the defendant 2 million rubles as an advance, after which the criminal sold the land plots to another person.
Then, for a long time, the fraudster avoided concluding a final purchase and sale agreement for the specified land plots, receiving money from the buyer in installments for the sale of the plots.
From September 2020 to December 2021, the victim paid the swindler through bank transfers and in cash in the total amount of 5,050,000 rubles, which is confirmed by receipts handwritten by the defendant and the history of bank transfers.
At the court hearing, the defendant did not admit guilt, but partially admitted guilt in one of the episodes.
The court, on the basis of the evidence collected and examined at the trial, came to the conclusion that the defendant was guilty and that his actions were correctly classified in all episodes of crimes under parts 3 and 4 of Article 159 of the Criminal Code of the Russian Federation as fraud — theft of someone else’s property or the acquisition of rights to someone else’s property by deception or breach of trust.
The civil claims of the victims were satisfied in full.
