A resident of Sevastopol will answer for committing fraud against a minor niece

The Main Investigation Department of the Investigative Committee of Russia for the Republic of Crimea and the city of Sevastopol completed the investigation of a criminal case against a 42-year-old resident of Sevastopol. She is accused of fraud on an especially large scale, which resulted in the deprivation of a citizen’s right to housing (part 4 of article 159 of the Criminal Code of the Russian Federation).
The investigative department for the Leninsky district established that the woman, being the guardian of her underage niece, knew that she had the right to inherit ½ of the land plot in the village of Ternovka. The other half was in the same right with her own daughter. There was also an unregistered residential building on the specified site.
Using the trust of her niece, a resident of Sevastopol in 2020 completed a survey of the land plot and executed an agreement on behalf of the ward in such a way that the existing house ended up in half of her own daughter. After that, the woman registered the building for her daughter, thereby depriving her niece of the rights to the rightful share of the house, which is the only housing for a minor.— reported in the Investigative Committee.
The illegal activity of the guardian was revealed by the prosecutor’s office. In order to restore the violated rights of the girl to land plots and a residential building, the investigation seized her.
At present, the investigation of the criminal case has been completed. An aggravating circumstance is the commission of a crime by a person who is responsible for the maintenance, upbringing, education, protection of the rights and legitimate interests of a minor.
The materials were sent to the prosecutor’s office for the purpose of studying, signing the indictment and sending the case to court.
