A single format of a machine-readable power of attorney will operate in Russia

A year after testing in the country, a single format of a machine-readable power of attorney (MPA) will be introduced based on the format by the Federal Tax Service and Federal Notary Chamber. According to the leadership of the Federal Tax Service, the innovation will work in the near future.

The standardized format of the «digital» power of attorney, which will be used in government agencies, the business environment, credit and other organizations, is designed to make electronic document management more efficient and secure. In addition, the spread of machine-readable powers of attorney opens up a number of advantages for business entities and, in general, for everyone who needs to issue a power of attorney.

From a security point of view, the introduction of a unified MHD format minimizes the likelihood of errors in processing such documents, their falsification and use for illegal purposes. The risks of violating the requirements of the law for the obligatory nature of a notarized form of a power of attorney will also be prevented, which often entails contesting transactions. It will be enough for the attorney to name only a special MCHD code, according to which the party requesting the document will be able to immediately find it in the register and verify the applicant’s authority.

In addition, the distributed ledger technology will eliminate the risks of acting on canceled or expired powers of attorney. The integration of the blockchain platform of the Federal Tax Service with the electronic register of orders to cancel the powers of attorney of the Federal Tax Service makes it possible to instantly obtain the current status of the power of attorney for all participants in the electronic interaction.

The process of issuing a “digital” power of attorney will also become easier. To obtain a machine-readable power of attorney in a notarial form, the principal does not need a personal enhanced qualified electronic signature. The notary will certify the power of attorney by signing it with his electronic signature and enter the document into the system. According to the Federal Notary Chamber, the procedure for issuing a machine-readable power of attorney in the established format will be approved in early 2023.

In the future, a single format of machine-readable powers of attorney (both notarized and not requiring certification) will simplify the receipt of services or the implementation of other legally significant actions in electronic form for a wide range of participants in civil circulation.

An experiment to test the technology for exchanging machine-readable powers of attorney was launched by the Federal Tax Service in September 2021. After acceptance Federal Law No. 443-FZ, which introduces the mandatory use of a machine-readable power of attorney from January 1, 2023, the Federal Tax Service extended testing until the end of this year. Over the year, in addition to the FNP, the Russian Post, Rosstat, VTB, all major EDI operators, etc., joined the experiment.
