Abduction, rape, beating, fraud: in Crimea a particularly dangerous recidivist was sent to the colony

The conviction was sentenced by the Saksky District Court of the Republic of Crimea earlier three times a convicted 37-year-old resident of the city of Saki, found guilty of crimes under: part 2 of article 116.1 of the Criminal Code of the Russian Federation — the commission of violent actions that caused a physical pain by a criminal record for a crime committed with the use of violence; Part 1 of Art. 159 of the Criminal Code — fraud, that is, the theft of someone else’s property by abuse of trust; p. «B, g» part 2 of Art. 126 of the Criminal Code — the abduction of a person committed with the threat of violence that is dangerous to life and health, using objects used as a weapon; p. «B» of part 2 of article 131 of the Criminal Code — rape connected with the threat of murder; p. «B» of part 2 of article 132 of the Criminal Code of the Russian Federation — other sexual actions with the use of violence to the victim, combined with the threat of murder.

The court, having examined the materials of the criminal case, established the following. 01/09/2024 The defendant asked his friend to leave him for temporary use a mobile phone, which was not going to return, but laid him in a commission store, thereby committed theft; 02.27.2024 stroke the head in the face of an unfamiliar woman who made him a remark for unworthy behavior on the street; 02/27/2024 brought a familiar girl to his home, holding her illegally, expressing threats with a knife in his hands, raped and committed other violent actions of a sexual nature.

The fault of the defendant in committing crimes incriminated to him was fully proved by evidence investigated in court.

As the circumstances mitigating the punishment, the court recognized the presence of the accused with strong social connections and attachments, the provision of material and feasible assistance to the elderly mother, the presence of a minor child of a civilian spouse, an unsatisfactory state of health, and bringing the apology to the victim, a partial confession of guilt. The court recognized the court with an aggravating punishment by a particularly dangerous relapse of crimes.

The court by partial addition of the sentenced punishments on the aggregate of crimes imposed the convicted person with the final punishment in the form of 14 years in prison with the serving of a sentence in a correctional colony of a special regime with a limitation of freedom for a period of 2 years.

The sentence did not enter into legal force.
