Housing inspectors will gain access to apartments without permission from the prosecutor’s office if it turns out that the owners are carrying out unauthorized redevelopment. Today, state housing supervision authorities are required to obtain permission through the court if apartment owners deny them access to the premises, the document notes. Today, it may take inspectors several months to obtain permission to inspect apartments for damage, State Duma deputy Galina Khovanskaya, head of the commission for ensuring the housing rights of citizens, explained to Izvestia.

During this time, anything can happen to the house, including collapse. After all, there are such redevelopments when load-bearing walls are demolished. We all remember the recent incident in Astrakhan, where after such a reconstruction of one apartment a five-story building collapsed. Or a case in Moscow, where the owner of the first floor tried to increase his living space by using a basement and digging the earth under the wall of the house, which could not stand it and cracked,” the parliamentarian gave an example.

The cause of the collapse of a five-story building in Astrakhan was redevelopment. The tragedy occurred on the evening of November 16. On that day, an eyewitness reported to the duty station about a crack that had appeared in the wall of a building on Vokzalnaya Square. Soon after his appeal, the third and fourth entrances collapsed, damaging about 20 apartments. Before the collapse, 213 people, including 37 children, miraculously managed to evacuate from the building. One person died.

According to her, there are situations that require an immediate response from regulatory authorities, so this initiative of the Samara Duma must be supported. Galina Khovanskaya explained that after receiving all the feedback, the bill will be officially submitted to the State Duma.

As Izvestia found out, the document signed by the head of the regional Samara parliament Gennady Kotelnikov was sent to the State Duma Speaker Vyacheslav Volodin for legislative examination.

With this initiative, we want to increase the efficiency of housing inspections, which will be able to more quickly respond to citizens’ requests. The problem that it must solve is relevant not only for the Samara region, but for all regions. After all, a housing inspection with a positive court decision may not receive permission to check from the prosecutor’s office,” Denis Volkov, deputy chairman of the committee on housing and communal services, fuel and energy complex and environmental protection of the Samara Provincial Duma, explained to Izvestia.

Izvestia sent a request to the Prosecutor General’s Office with a proposal to evaluate the prospects for supporting the initiative.

No restrictions

The problem when the prosecutor’s office does not agree to inspections is due to the moratorium on their conduct, says Svetlana Razvorotneva, deputy chairman of the committee for construction and housing and communal services.

There are no scheduled inspections at all, and unscheduled inspections are carried out only in agreement with the prosecutor’s office and provided that there is a threat to life and health. This applies not only to checking redevelopments, but also to other checks, including the maintenance of common property in apartment buildings. Therefore, unfortunately, indeed, there are restrictions on inspections and the non-obviousness of the criteria of the prosecutor’s office, which in some places allows it and in others it doesn’t. — the deputy explained to Izvestia.

According to her, now there are such incidents when law enforcement agencies cannot even check the implementation of their own instructions.

Therefore, it is necessary to amend the legislation to ensure that all these restrictions on inspections should not apply to housing relations. So that Rospotrebnadzor and state housing inspectors respond to all citizens’ complaints without restrictionssays the deputy.

Executive Director of the Association “Housing and Utilities Control of the City of Moscow” Vera Moskvina agrees with this opinion.

When an article appeared in the Constitution that prohibited any access to an apartment without the permission of the owner, many problems arose. On the one hand, of course, housing must be protected from thieves and hooligans.
