Complex cadastral work in Crimea and Sevastopol — what you need to know
Krympress reports:
As in other regions of Russia, the conduct of complex cadastral works (KKR) is an integral part of the process of updating and clarifying the data of the Unified State Real Estate (USRN). The initiator of these works in the Republic of Crimea is the Ministry of Property and Land Relations of the Republic of Crimea (MISO), in the city of Sevastopol — the Department of Property and Land Relations of the city of Sevastopol (DIZO), and the contractor — PPC Roskadastast in the Krasnodar Territory.
Consider how the copyright holder of real estate should act during the CCR.
Stage 1: Notice of the beginning of work
The first step is to receive a notice from the CCR performer. The notice is sent to copyright holders to e -mail and public services. It is important to regularly check your email. Information about the start of work is also published on the official websites of the Goskomarest, Miso, Sevraestra and Diso. It is recommended to monitor these resources for relevant information.
Stage 2: clarification of the boundaries of the land and the capital construction facilities located on it
The key point in the KKR is to clarify the boundaries of land. In the process of this procedure, the area of the site may change. The legislation establishes permissible limits of changes in the area: a decrease or increase should not exceed 10% of the area specified in the USRN. If the area has decreased or increased by more than 10%, the situation changes significantly.
Stage 3: Consent to a change in area by more than 10%
In the case when the area of the site changes by more than 10%, the inclusion of information about this site in the map of the territory is possible only with the written consent of the copyright holder. This consent should be executed properly and attached to the card plan of the territory. The lack of such consent automatically suspenses the state cadastral registration. Therefore, it is extremely important to carefully study the results of the KKR and make a balanced decision. If you do not agree with the measurement results, you must contact the MISO (Republic of Crimea) or Dizom (Sevastopol) to represent a motivated objection.
Stage 4: The actions of the copyright holder
The copyright holder cannot impede the conduct of the KKR. This is established by law. However, the copyright holder has the right:
- request information and documentation with the contractor,
- get acquainted with the results of the KKR and check them for compliance of reality,
- appeal the results.
If questions or difficulties arise, it is recommended to consult a qualified lawyer or cadastral engineer for advice. In conclusion, the active position of the copyright holder and timely familiarization with information about the CCR is the key to a successful and painless completion of the process of updating the USRN data. Carefully study all the incoming information and feel free to seek explanations to the competent authorities, ”the press service of the head of the department of geodesy and cartography of the Rosreestr Department for the Republic of Crimea and Sevastopol Julia Isosimina quoted.
