Crimean customs: before purchasing a foreign car, make sure that the car is “clean”

Crimean customs has repeatedly identified facts of transfer and sale of foreign vehicles for personal use that were temporarily imported into the territory of the EAEU.
Often, citizens, when purchasing such vehicles, do not check whether there are restrictions on cars from customs authorities. This position often leads to administrative fines, and sometimes, when the amount of unpaid customs duties exceeds 2 million rubles, to criminal liabilitynotes the deputy head of the Crimean customs, Valery Tikhonov.
We remind you that the transfer of the right to use and (or) dispose of foreign vehicles for personal use to other persons without performing customs operations for customs declaration or without permission from the customs authority, in violation of paragraphs 7-9 of Article 264 of the EAEU Labor Code, constitutes an administrative offense, liability for which is provided for in Part 2 of Article 16.24 of the Code of Administrative Offenses of the Russian Federation.
Simultaneously with the bringing to administrative responsibility, the person who transferred the right to use and (or) dispose of a temporarily imported foreign vehicle to another person without the permission of the customs authority, and the person who accepted this vehicle, have a joint obligation to pay customs duties and taxes at the rates established in accordance with the international treaty of the EAEU member states.
Crimean customs reminds:
Foreign individuals may import vehicles for personal use, registered in a state that is not a member of the Union, without paying customs duties for the period of their temporary stay, but not more than one year (Article 264 of the EAEU Customs Code). Persons of member states of the Union have the right to import vehicles for personal use, registered in a state that is not a member of the Union, for a period of no more than one year, subject to the provision of security for the fulfillment of the obligation to pay customs duties and taxes.
Temporarily imported vehicles for personal use before the expiration of the period during which they can temporarily remain in the customs territory of the Union are subject to customs declaration for the purpose of export from the customs territory of the Union, release for free circulation or for other purposes in accordance with the EAEU Labor Code.
