Crimean customs opened 13 cases of administrative offenses in 2024

Since the beginning of 2024, Crimean customs has opened 13 cases of administrative offenses for violation of the temporary import period. Based on the results of the consideration of the cases, penalties were imposed in the form of a warning and an administrative fine. By decision of the judicial authorities, 1 vehicle was confiscated. 2 vehicles were seized for failure to export them from the territory of the Eurasian Economic Union later than 6 months from the date of expiration of the deadline.
The inattention of citizens and the malfunction of vehicles are the main reasons for non-compliance with the temporary import period. In this case, whatever the reason (except for the seizure of the vehicle or the seizure of it), the period of temporary import of the vehicle is not suspended. Therefore, if a temporarily imported vehicle is involved in an accident, or for some other reason cannot independently leave the territory of the EAEU, then before the expiration of the temporary import period, all measures must be taken (for example, using a tow truck) to ensure the removal of the vehicle. Reference. Crimean customs reminds that foreign individuals can import vehicles for personal use, registered in a state that is not a member of the Union, without paying customs duties for the period of their temporary stay, but not more than one year (Article 264 of the EAEU Customs Code). Persons of member states of the Union have the right to import vehicles for personal use, registered in a state that is not a member of the Union, for a period of no more than one year, subject to the provision of security for the fulfillment of the obligation to pay customs duties and taxes.
Temporarily imported vehicles for personal use before the expiration of the period during which they can temporarily remain in the customs territory of the Union are subject to customs declaration for the purpose of export from the customs territory of the Union, release for free circulation or for other purposes in accordance with the EAEU Labor Code.
If, before the expiration of the established period, the temporarily imported car was not exported, Part 1 of Article 16.18 of the Code of Administrative Offenses of the Russian Federation (CAO RF) provides for punishment in the form of an administrative fine in the amount of one thousand five hundred to two thousand five hundred rubles with confiscation of goods and (or) vehicles that were the subject of an administrative offense, or without it.
At the same time, please note that in accordance with subparagraph 5 of paragraph 2 of Article 268 of the EAEU Labor Code, the obligation to pay customs duties and taxes is terminated, including if the following conditions are simultaneously met:
customs declaration of such vehicles for the purpose of export from the customs territory of the Union is carried out no later than 6 months from the date of expiration of the period during which temporarily imported vehicles for personal use can be temporarily located in the customs territory of the Union;
in relation to such vehicles, the deadline for payment of customs duties and taxes in connection with the transfer of these vehicles has not arrived in violation of the requirements of Article 264 of the EAEU Labor Code.
If the declarant has fulfilled the obligation to pay customs duties (payment of arrears of customs duties and taxes in full) for violation of the terms and (or) conditions of temporary import of vehicles, such vehicles are subject to declaration for the purpose of export, release for free circulation or other purposes in accordance with the Customs Code of the EAEU (clause 5 of Article 264 of the EAEU Labor Code).
