“Cunning” changes to the technical plan of a residential building are punishable. An engineer from Sevastopol is now in the know

The prosecutor’s office of the Gagarinsky district of Sevastopol, according to information from the Sevreestr, with the involvement of specialists from Sevgosstroynadzor, conducted an audit of the implementation of legislation on cadastral activities.
It was established that the cadastral engineer prepared a technical plan for a two-story residential building on the street. Chelnokova. On its basis, in January 2023, the customer registered ownership of the property.
However, in reality such a house does not exist at the address indicated in the documentation. In its place is an unfinished construction site that is still unsuitable for habitation. At the time of inspection, it did not have a roof, windows, doors, balcony slab railings, communications– reports the press service of the Sevastopol prosecutor’s office.
Based on this fact, the district prosecutor opened an administrative case against the cadastral engineer under Part 4 of Art. 14.35 of the Code of Administrative Offenses of the Russian Federation (a cadastral engineer entering knowingly false information into the technical plan, if these actions do not contain a criminal offense).
Having examined the case materials, the magistrate of judicial district No. 14 of the Leninsky judicial district of Sevastopol fined the guilty person 30 thousand rubles.
The cadastral engineer who committed the violations appealed the decision of the court of first instance, but the Leninsky District Court of Sevastopol rejected his appeal. The court decision entered into legal force.
