“Dashed off” for a new conviction and confiscation of a car — a court decision in the Sovietsky district of Crimea

The Sovetsky District Court of the Republic of Crimea sentenced a resident of the Sovetsky District for driving a car by a person deprived of the right to drive vehicles and subjected to administrative punishment for an act provided for by part 4 of article 12.7 of the Code of Administrative Offenses of the Russian Federation (part 1 of article 264.3 of the Criminal Code of the Russian Federation).

As established by the court, in mid-April 2023, in the evening, a 45-year-old local resident previously deprived of the right to drive vehicles, who was also subjected to administrative punishment for re-driving a vehicle without the right to drive a vehicle, decided to sit down again the steering wheel of his car. After that, moving along the Sovetsky-Privolnoe highway of the Sovetsky district of the Republic of Crimea, the car driven by the defendant was stopped by the traffic police— noted in the press service of the court.

At the hearing, the defendant fully admitted his guilt in committing the crime, and repented of his deed.

According to the nature and degree of public danger, the committed crime belongs to the category of minor gravity.

Circumstances mitigating the punishment of the defendant, the court recognized the active contribution to the disclosure and investigation of the crime, full recognition of guilt, remorse for the deed, the presence of a minor child of the perpetrator.

Having comprehensively studied the materials of the case, taking into account the nature and degree of public danger of the committed act, the court found the Crimean guilty of the committed crime, and in accordance with Part 1, Part 5 of Article 70 of the Criminal Code of the Russian Federation, he was sentenced to a final punishment in the form of compulsory labor for a term of 280 hours, with the deprivation of the right to engage in activities related to driving vehicles for a period of 2 years 4 months 5 days.

The car belonging to the defendant, which he drove in the commission of the crime, the court decided to confiscate to the state.

The verdict did not enter into force.
