Media reports about fines for an incorrectly installed door to the apartment. The owners warned that they could be fined for the opening of the front door out. If the owner of the apartment arbitrarily installed the front door so that it opens out, it can be fined 15 thousand rubles, as this violates the fire safety rules.
Lawyers surveyed TASSrefuted this information. In paragraph 4.2.22 SP 1.13130.2020 “Fire protection systems. Evacuation routes and exits ”there really is such a requirement. It states that the doors of the evacuation exits and doors on the evacuation routes should open in the direction of exit from the building, said lawyer Ekaterina Tyutyunnikova. She emphasized that this requirement is applied only at the design and construction stage and is not related to the owners of finished apartments. The information that the owners of the apartments will be fine for the fact that the door opens “in the wrong direction” does not correspond to reality, the lawyer emphasized. She called such messages «hype in the field of legal regulation of housing and communal services.»
The door to the apartment itself is not an evacuation route and does not fall under fire safety standards, Olga Vlasova, adviser to the Federal Chamber of Lawyers of the Russian Federation, explained. But if the specific front door interferes with evacuation, since it opens in the wrong direction, the regulatory authorities can consider this a violation and demand to reinstall the door.
Tyutyunnikova recalled that the dispute about the direction of opening the front door was previously considered by the Judicial Collegium for Civil Cases of the Supreme Court. The residents of one of the apartments installed the front door opening out, but the neighbors said that this violates their rights and threatens security. The Supreme Court explained that the requirements for the direction of opening of the doors are applied at the design and construction stage. These norms do not apply to the changes that the owners make if there is no obvious threat to the safety of residents. In this case, the neighbors could not prove that the front door prevents evacuation or violating the rights of other residents. The Armed Forces came to the conclusion that the owners of the apartment can independently determine the door parameters.
Tyutyunnikova emphasized that in the legislation there are no clear grounds for the fine to open the front door to the outside.
The People’s Front expert Pavel Sklynchuk confirmed that the front door could open in any direction, the fines are not provided for this.
