Educational program: 3 new laws of November that relate to real estate and housing and communal services

On November 1, 2024, 3 regulations relating to real estate and housing and communal services came into force at once: new rules of fire safety, liability for damage to common property and the procedure for inheriting real estate.

The updated set of rules “Fire Protection Systems” has changed the requirements for the layout of real estate. Now any room that can simultaneously accommodate from 501 to 1,000 people must have at least three emergency exits. If the room is intended for the simultaneous occupancy of 1,000 people or more, there must be at least four exits. The requirements for turnstiles in the halls and lobbies of buildings have also been clarified — it must be possible to open them manually and lock them in the open state.

Another November change was made to the Civil Code. If one of the homeowners caused harm common property — committed an act of vandalism, violated fire safety rules or unauthorizedly rearranged the common premises — he is obliged to compensate for the damage himself. Previously, the consequences were most often eliminated by the management company. An important point: the owner’s guilt must be proven in court.

The third innovation of November concerns inheritance and donation of real estate. According to the text of the new order of the Federal Tax Service notaries will transmit information to the tax office about the facts of inheritance and donation using two new forms:

Information on the issuance of a certificate of inheritance» and «Information on the notarization of the gift agreement.» The changes are rather technical and are unlikely to be noticeable to ordinary citizens, RBC quotes a lawyer from Propositum.

Their goal is to promptly inform the tax service about a change in home ownership so that it can correctly calculate the amount of taxes.
