Educational program: what needs to be taken into account when employing full-time students

Director of legal practice at SuperJob Alexander Yuzhalin told city residents what they need to consider when hiring full-time students. The hiring of full-time students is carried out according to the general procedure, taking into account a number of features related to the status of such an employee.

  • Firstly, an employer can enter into a fixed-term employment contract with a student receiving full-time education (by agreement with the employee himself). Also, a fixed-term employment contract is concluded when a student is hired for the purpose of completing an internship or internship as part of their studies.
  • Secondly, the age of the employee must be taken into account. If the employee is under 18 years of age, he is subject to the guarantees established for minor workers. For example, such employees are given reduced working hours (depending on the age of the employee), they cannot be hired for jobs that are prohibited for minors (work in hazardous conditions, nightclubs, selling alcohol, etc.). Also, such employees have the right to annual paid leave of 31 calendar days. Such workers cannot be involved in night work, overtime work, work on weekends and holidays, or sent on business trips (with the exception of workers in creative professions). These guarantees are provided until employees reach the age of 18.

As a rule, a full-time student is a person who has already reached the age of 16, so no additional consent to conclude an employment contract is required from third parties.

Thirdly, the employer is obliged to provide additional leaves without pay for full-time students. Thus, university students must be granted leave without pay:

  • for passing intermediate certification — 15 calendar days per academic year;
  • for preparing and defending the final qualifying thesis and passing the final state exams — four months;
  • for passing final state exams — one month.

Employees who study full-time in secondary vocational education programs must be granted leave without pay:

  • for passing intermediate certification — 10 calendar days per academic year;
  • for passing the state final certification — up to two months.

Otherwise, the procedure for hiring a full-time student will follow the general rules.
