Exceeding the area of ​​plots for personal farming is the reason for the suspension of registry actions

Exceeding the total area of ​​plots established by law for running personal subsidiary plots is the reason for suspension of registration actions. Deputy Chairman of the State Committee for State Registration and Cadastre of the Republic of Crimea, Yulia Zhiganova, recalled the significant norms of land legislation in the field of registration.

According to the provisions Federal Law No. 112-FZ “On personal subsidiary plots”a citizen can become the copyright holder of a plot with the type of permitted use «personal subsidiary plot» (LPH) with a total area of ​​0.5 hectares. It does not have to be one solid section; there can be several of them. The total area is calculated by simply adding the sizes of all plots, regardless of the type of right to them.

However, in addition to the federal law, the issue of ownership by individuals of land for private household plots is separately regulated by the constituent entities of the Russian Federation. Each of them is empowered to increase the maximum land area for private household plots in the region. In the Republic of Crimea, according to Law No. 66-ZRK «On the provision of land plots owned by the Republic of Crimea or municipal property, and some issues of land relations» citizens are allowed to own additional land for running private household plots in an amount of no more than 2 hectares. With the obligatory condition that these land plots must be located outside the borders of villages, towns and cities.

This means that in Crimea, citizens can become legal holders of a total of 2.5 hectares of land for private household plots: of which no more than 0.5 hectares should be located within the boundaries of populated areas and no more than 2 hectares outside their borders.

Compliance with the norms and rules established by law is carefully checked by Goskomregister employees when registering a transaction. In case of exceeding the permissible area of ​​land per citizen, registration actions are suspended,” recalled Yulia Zhiganova.
