In many villages or SNTs there are abandoned plots. If there is a dilapidated house there, homeless people can settle there, and weeds can move over the fence to the neighbors. The law on amendments to the Land Code, which will come into force on March 1, 2025, is designed to change this situation. The prepared draft resolutions of the Cabinet of Ministers specify the signs by which one can understand that a plot of land is not being used, as well as what needs to be done to develop it. How else were landowners advised to take care of their property and what will happen if this is not done, was examined «Parliamentary newspaper».
Fight for abandoned places
Several years ago, Russia began to address the problem of abandoned plots of land in order to hold their negligent owners accountable. Including those who bought land when it was cheap and are waiting for it to be sold at a higher price, but do not use the plot for its intended purpose. Is it any wonder that abandoned and overgrown with weeds and bushes appear next to well-kept houses and summer cottages?
A law that will come into force on March 1, 2025, will help force careless owners to clean up their plots. The authors explained what is meant by the development of a land plot from the lands of populated areas. In addition, the Cabinet of Ministers has prepared two draft resolutions, thanks to which Rosreestr employees will be able to figure out whether the land is being used for its intended purpose, and what the owner needs to do to properly develop his acres.
In particular, the first document specified what the signs of non-use of land plots are. For example, if there has been no foundation for a building or structure for the construction of which the land plot is intended for more than two years.
Another such sign will be the absence “on the land plot for five or more years of a building or structure for the construction of which the plot is intended and in relation to which state registration of rights to such buildings or structures has been carried out,” the draft resolution states.
The reason for Rosreestr to pay attention to the site will also be the situation if there is a house, but the owners do not come for a long time. Meanwhile, the housing is deteriorating and falling apart: there has been «damage to the roof, walls, foundation» for more than five years, broken glass in the windows, or none at all. Littering the site more than half will also be a sign of non-use of the land.
Don’t grab something valuable in your arms
The second draft of the resolution states what needs to be done to develop the land plot. In particular, to clear it of rubbish and garbage, to drain the land if it is swampy, and, on the contrary, to moisten it if it is excessively dry.
It is also necessary to get rid of trees and shrubs, weeds, of course, without touching the trees and plantings grown for the improvement and landscaping of the land plot. At the same time, «objects of the plant world, the species of which are listed in the Red Book of Russia or regional ones» should not be harmed. After all, this can lead to the death, reduction in numbers or disruption of the habitat of the corresponding species of animals or plants, the authors of the draft resolution emphasized. Therefore, when freeing hundreds of square meters from weeds, it is forbidden to destroy the red-listed snowdrop, lily of the valley or yellow iris, which could have grown during the absence of the owners for several years. Such actions can result in serious punishment.
In October 2023, a law came into force in Russia, according to which criminal liability was introduced for the destruction, collection, storage, illegal acquisition, sale and transportation of especially valuable plants and mushrooms that are listed in the Red Book of Russia or regional, recalled Polina Trishina, a lawyer for the Moscow Union of Gardeners, in an interview with Parlamentskaya Gazeta. The penalty for the destruction of rare plants listed in the Red Book of Russia or protected by international treaties is up to five thousand for citizens, up to 20 thousand for officials and up to one million for companies.
So that it doesn’t hurt so much
When a person purchases a plot of land, he must understand that ownership imposes a certain responsibility, believes Polina Trishina.
The most important result of non-use or non-development of a land plot may be its seizure by court order from the negligent owner.— the lawyer emphasized.
And if the territory is not used for the purpose specified in the land documents for three years and the buildings erected on it are not registered in the Unified State Register of Real Estate, then the owner is first given a warning, but if there are no results after a year, then the land can be lost by a court decision. Moreover, if the owner of the plot is issued an order to eliminate violations, he will not be able to mortgage the land, give it away or sell it until the court’s requirements are met.
In addition, careless summer residents face financial penalties if they do not properly maintain their plots and allow them to become polluted and overgrown. If Sosnowsky’s hogweed, medicinal dandelion, poppy, fragrant medicinal chamomile, field mint, common tansy, and field sow thistle grow there, they can be fined from 300 to 500 rubles. And in the regions, additional sanctions can be imposed. For example, in the Moscow region, such a mistake will cost five thousand rubles.
Punishment will also be imposed for cultivating illegal narcotic plants: opium poppy, mimosa hostilis, Hawaiian rose, hemp, sage of fortune tellers, morning glory. If something from this list grows on a plot, its owner will face a fine of up to 40 thousand rubles, correctional labor, and even criminal liability.
Dacha owners should remember to remove dry grass in a timely manner so as not to violate fire safety requirements. If you do not do this, you can run into an administrative fine of two to five thousand rubles.
If the owner does not take care of the removal of garbage from the site, he can pay from two to three thousand rubles, and for a repeated violation — from three to five thousand. And if littering the site is assessed as causing environmental damage, the fine will be from 20 to 50 thousand rubles.
