Fireworks in honor of a birthday resulted in a large fine. Case in Kerch

Kerch police brought administrative charges against a citizen who violated the ban on the use of pyrotechnics.
While monitoring the Internet, police officers discovered information that on one of the city streets unknown people were using pyrotechnic products of the “Salute” type. The fireworks were visible and heard from several blocks away and scared residents on nearby streets. During the verification activities, the police identified a 52-year-old local resident who decided to set off fireworks along with the guests in the common yard on her birthday— reported the Ministry of Internal Affairs of the Republic of Crimea.
It is emphasized that by her actions the citizen violated the provisions of the decree of the Head of the Republic of Crimea establishing a ban on the use of pyrotechnics.
In relation to the offender, the police drew up a protocol on an administrative offense under Part 1 of Art. 20.6.1 Code of Administrative Offenses of the Russian Federation (failure to comply with the rules of conduct in case of an emergency or the threat of its occurrence). The sanction of the article provides for punishment in the form of a fine of up to 30 thousand rubles.
Let us remind you that according to the Decree of the Head of the Republic of Crimea dated 09.09.2022 No. 214-U “On amendments to the Decree of the Head of the Republic of Crimea dated 24.02.2022 No. 32-U”, a ban on the use and use by physical and legal entities of pyrotechnic products, with the exception of pyrotechnic products corresponding to hazard class 1 according to the technical regulations of the Customs Union “On the safety of pyrotechnic products” (crackers, sparklers, cold fire fountains).
REASONABLE QUESTION: Isn’t it easier then to ban the sale of “New Year’s pyrotechnics?” Nowadays there are queues in such shops. After all, there are holidays, habits, and sales are free… ANSWER: No, it’s not easier. It would be easier to ban the use of pyrotechnics. This is within the competence of regional authorities. But with the sale — to intervene in issues of freedom of enterprise, a higher level is needed, up to changes in federal laws. Legislators and the entire vertical of government power are unlikely to agree to this. Business is a sacred cow. Then ANOTHER QUESTION is reasonable: Isn’t it clear that those who buy fireworks, salutes, firecrackers and other “crackers” will not put them on a shelf to admire, but will use them for their intended purpose? And it’s even 100% clear when exactly. Uh… the ban, it turns out, is some kind of selective. And one can only sympathize with the delinquent birthday girl from Kerch…
