FNP seminar: ethical standards of professional activity of a notary

Heads of notary chambers of the constituent entities of the Russian Federation, as well as chairmen and members of specialized commissions gathered in Moscow at a seminar on the application of the Code of Professional Ethics of Notaries in the Russian Federation.

The notary community of the city of Sevastopol was represented at this event by notary Natalya Kiryukhina.

Compliance with uniform ethical requirements is a necessary measure for the notary as a socially significant institution that plays an important role in the regulation of civil legal relations,” noted Konstantin Korsik, President of the Federal Notary Chamber, in his welcoming speech to the seminar participants.

An important step in strengthening the ethical foundations of notarial activity in the Russian Federation was the adoption in 2015 of the Code of Professional Ethics of Notaries in the Russian Federation. The Code for the first time legislated the concept of professional ethics of a notary as a norm, established rules of professional conduct, defined a clear list of disciplinary measures and the procedure for their application. Later, the Code was supplemented with provisions regulating the behavior of notaries off duty, as well as in the public field. The composition of disciplinary offenses was clarified and the paperwork regarding the disciplinary liability of a person temporarily replacing a notary was regulated.

Today, the Code of Professional Ethics of Notaries in the Russian Federation is a balanced document that, on the one hand, provides a framework and mechanisms for compliance with professional ethics, and on the other, clearly and effectively builds a system for protecting the rights of notaries,” emphasized Konstantin Korsik.

As Olga Serdyukova, chairman of the FNP Commission on Professional Ethics, noted, the ethical standards of a notary’s work are divided into four groups: informational, financial, territorial and communication. In particular, they relate to compliance with the requirements for professional liability insurance of a notary, performance of notarial acts within one’s notarial district, business communication standards, etc.

At the same time, as noted by the Chairman of the Council of Young Notaries, Sergei Polyakov, the key principle, including in terms of ethics, is the public legal status of the notary profession. It is he who determines the standards of behavior of a notary both on and off duty, the rules for the presence of a notary in the public field, including on social networks, and his participation in certain public organizations.

Elena Afanasyeva, Deputy Chairman of the FNP Ethics Commission, focused on judicial practice on the application of the Code of Professional Ethics of Notaries in the Russian Federation. The speaker emphasized that the Code was adopted in accordance with the requirements of the legislation on notaries and has the status of a corporate regulatory act, which is also confirmed by judicial practice.

The participants of the seminar were able to discuss in detail the practical issues of applying certain norms of the Code of Ethics during a round table with members of the specialized commission of the FNP. Also, as part of the seminar, students underwent training on the psychology of business communication, organized by Marina Mdivani, a leading researcher at the Psychological Institute of the Russian Academy of Education
