For theft and hijacking — an educational colony. Sentence of the Bakhchisarai District Court to a teenager

The Bakhchisaray District Court of the Republic of Crimea sentenced a repeatedly convicted minor resident of Bakhchisaray for committing crimes on three counts — theft of property and theft of a motorcycle. One of the fragments of his criminal activity was the theft of a winch from a car belonging to the Ministry of Defense of the Russian Federation. The perpetrator was sentenced to 1 year 10 months of imprisonment to be served in a correctional colony.

As established by the materials of the criminal case, in mid-July last year at about 11 p.m., a young resident of Bakhchisara, born in 2006, together with an accomplice, entered a barn located on the territory of one of the private households of the city, where they stole a gasoline generator. The owner of the generator who suffered from this crime suffered damage in the amount of 40,000 rubles. A month later, a teenager, while intoxicated, walking around the city late at night, saw a Honda motorcycle parked under a tree in one of the courtyards of an apartment building. At that moment he had a desire to ride this motorcycle to his home. Having rolled the motorcycle away from its parking spot several tens of meters along the roadway, realizing that he could not bring the bike, the attacker abandoned the motorcycle and left the crime scene, — the details of the case were announced by the press service of the court.

In addition, at the end of September, the teenager, being drunk, at about three o’clock in the morning, together with an old acquaintance, walked through the courtyards of apartment buildings. In one of the courtyards, the accomplices saw a passenger pickup truck, the body of which was covered with an awning. The juvenile defendant entered the back of a pickup truck from where he stole an automobile electric winch. The stolen car belonged to the Russian Ministry of Defense. With his criminal actions, the minor defendant caused damage to the Ministry of Defense in the amount of 89,000 rubles.

In relation to the accomplice of a minor offender, the criminal case has been separated into separate proceedings, since the accomplice of the thefts has reached the age of majority.

At the court hearing, the defendant declared his full agreement with the charges brought against him and admitted his guilt in full.

The court came to the conclusion that the minor defendant was guilty and the qualifications of his actions were correct in all episodes of crimes — according to paragraphs. “a, b, c” Part 2 of Article 158 of the Criminal Code of the Russian Federation, as a secret theft of someone else’s property, committed by a group of persons by prior conspiracy, with illegal entry into the premises, causing significant damage and under Part 1 of Article 166 of the Criminal Code of the Russian Federation, as unlawful taking of a vehicle without the purpose of theft (theft).

The civil claim of the victim of the generator theft was partially satisfied in the amount of 20,000 rubles.

The Russian Ministry of Defense did not file a civil claim.

The verdict did not enter into legal force.
