Foreigners included in the register of controlled persons cannot make real estate transactions in Crimea

On the official website of the Ministry of Internal Affairs of Russia, the service began to function «Register of controlled persons» — a departmental database with relevant information about foreigners illegally located in the Russian Federation.
According to Art. 11 of the Federal Law No. 260-ФЗ, which entered into force on February 5, 2025, a number of restrictive measures should be applied to the foreign citizenships indicated in this base, such as the ban on the acquisition of real estate, as well as the ban on any actions on state cadastral registration and (or) state registration of real estate rights.
Foreigners entered into the register of controlled persons will be denied any statements and documents for the implementation of state cadastral registration and (or) state registration of real estate rights, including for the alienation of real estate, making information about previously recorded real estate, registration of rights (both previously arising from the moment of state registration), as well as applications for the correction Registry error.
If in some way a foreign citizen manages to submit an application for services of the accounting and registration sphere, state registrars will already be checked by his passport data, whether the announcer is contained in the register of the Ministry of Internal Affairs. If the name of the foreigner is on the list, then he is in the Russian Federation illegally, and in any case he will be denied the provision of services.
At the same time, the migration legislation does not contain a ban on submitting applications to foreigners on the entry of information on the initiative of the interested person or in a notification manner, applications for the correction of a technical error, as well as a request to provide information from the USRN.
One way or another, migrants will be able to put the property for cadastral registration and register rights only after bringing their legal status in accordance with the requirements of Russian legislation and excluding controlled persons from the register.
Not only representatives of authorities and state institutions, but also individuals will have access to the register of controlled persons. Thus, citizens, before alienating real estate to a foreign person, will be able to independently verify data on it and, if personal data of such a participant in the transaction in the register, do not waste time concluding an agreement with him— said Julia Zhiganova.
