Goskomregister of the Republic of Crimea: entering an email address into the USRN will additionally protect real estate from fraudsters

Entering the owner’s e-mail address into the Unified State Register of Real Estate (EGRN) will help further secure his property from fraudsters. The State Committee for State Registration and Cadastre of the Republic of Crimea recalled the existing legal ways to protect their real estate.

First of all, employees of the state body, state registrars of rights, who conduct mandatory legal examination of incoming documents, protect the property interests of right holders. Since the registrar is personally responsible for his actions, he must make sure that there are all necessary legal grounds for the provision of public services, — noted in the press service of the State Register of the Republic of Crimea.

In order to verify the authenticity of documents and the information contained in them, Goskomregister specialists send interdepartmental requests through secure communication channels and make decisions, including based on the responses received.

At the same time, property owners, as interested parties, can also take measures on their part to protect property.

Thus, it is advisable for real estate owners to provide their e-mail address for inclusion in the Unified State Register of Real Estate, which will allow them to quickly receive information about any actions with property. For example, if documents are received to register the transfer of rights in relation to real estate, including in electronic form, the owner will receive a notification to his “electronic”. If we imagine that the transaction was not initiated by the owner of the property and indicates illegal actions of third parties in relation to the property, then the owner will be able to promptly apply to the State Register to suspend the transaction— Yulia Zhiganova, Deputy Chairman of the State Register, notes.

You can enter an e-mail into the USRN in the multifunctional center «My Documents» when applying for registration of real estate, indicating it in a separate column. Also, the applicant can submit a separate application for entering information about the e-mail address into the USRN. The service is free.

Another way to protect against fraudsters is to file an application on the impossibility of state registration of the transfer, restriction, termination of the right to real estate belonging to him without the personal participation of the copyright holder. This mechanism provided by the Federal Law No. 218-FZ «On state registration of real estate», allows you to minimize the risks of fraud in case of loss of a passport or documents of ownership, in the event of a long departure of the copyright holder, as well as when trying to sell someone else’s property with a fake power of attorney. If the USRN contains a corresponding entry, upon receipt of an application for registration of the transfer of rights, termination of ownership or encumbrance submitted by a person who is not the owner of the object or his legal representative, the documents will simply be returned without consideration.

The right holder can apply for a ban on registration actions without personal participation through the MFC or do it remotely on the portal Rosreestr (in the presence of an electronic digital signature). You can also send a letter to the postal address of the registration authority, however, in this case, the signature on the application must be notarized. The redemption of the «prohibitive» entry in the USRN is made on the basis of a judicial act that has entered into force or the owner’s application for the redemption of the entry on the previously submitted application for the impossibility of registration.
