Goskomregister of the Republic of Crimea: erroneously paid state duty for registration of rights can be returned within three years

Erroneously paid state duty for state registration of rights to real estate can be returned within three years. The current legislation defines exactly the period within which a payment receipt can be attached to the application and package of documents for the return of funds if they were paid by mistake or in a larger amount than provided for by law.
Any applicant who has to apply for registration services wonders whether he needs to pay a state fee for registration actions or not. This is especially true for capital facilities and land plots registered by the relevant authorities before March 21, 2014. The Goskomregister reminds: if the right to a house, apartment, plot or office space arose during the Soviet or Ukrainian period, then the state duty for registering previously arose rights is not charged. Not all registration actions require payment of a state fee, and this list is also determined by law.
If there are doubts about whether a state duty is required or not, the State Committee for State Registration and Cadastre of the Republic of Crimea recommends taking into account the following circumstances.
If a state fee was required when submitting documents, but was not paid by the applicant, they will be returned without consideration. This means that the documents will not be accepted and will have to be submitted again. Repeated submission of an application and documents, in turn, can cause additional hassle, for example, if several citizens living in different cities require simultaneous submission of an application. If the state duty was actually paid and the receipt was attached to the application, but this was not necessary, the money can be returned in the prescribed manner. The payer can submit a corresponding application, indicating the necessary details and attaching the necessary documents. The period for consideration of the application is up to 30 calendar days. In this case, the submitted documents will be processed and will not cause the documents for registration of rights to be returned without consideration.,” said Deputy Chairman of the State Registration Committee Yulia Zhiganova.
