The state fee for registering the right of common shared ownership of a real estate object with the simultaneous application of all co-owners is divided between them equally, and not in proportion to the share of each. This was announced by Yulia Zhiganova, Deputy Chairman of the State Committee for State Registration and Cadastre of the Republic of Crimea. In connection with the appeals of citizens coming to the State Register, the deputy chairman of the committee explained some features of the current legislation. The amount of the state duty for legally significant actions, including state registration of rights, is established by the Tax Code of the Russian Federation (TC RF) . The same document regulates the procedure and terms for depositing funds. In particular, articles 56. The Tax Code of the Russian Federation stipulates that if several right holders apply for a public service at the same time, the fee is paid by them in equal shares .
A common example is the execution of documents for an apartment. In accordance with the Tax Code of the Russian Federation, the state duty for registration of rights is 375 rubles. If the object has 4 owners, then when applying simultaneously, each of them will have to pay 500 rubles, regardless of the size of the share in the right. For three co-owners of one apartment, with simultaneous application, each will need to pay 375 rubles 39 kopecks. Some citizens believe that they should pay in proportion to their share. That is, if the applicant owns, for example, 1/5 of the share of the apartment, then he believes that 278 rubles will be enough. This is a misconception, as a result of which documents have to be returned without consideration, because the state duty is less than that established by law. The law does not prohibit in some cases each of the owners to register their share independently. For example, when registering property by inheritance or by a court decision. If among the applicants who simultaneously applied for registration of common property, there are persons exempt from paying the state duty, then part of the state duty of the beneficiary is deducted from the total amount.
