Heraldists of Sevastopol, notes «Sevastopol newspaper», are outraged that a lollipop with the image of city symbols and in the colors of the Russian flag appeared on sale. They saw in this signs of desecration of state symbols. Members of the expert group of the Heraldic Commission under the governor of Sevastopol wrote an open letter in which they announced “the catastrophic state of affairs in the field of heraldry” in the hero city.
The reason for our open appeal was a subtle but significant fact: in a number of retail outlets in the hero city of Sevastopol, a confectionery product appeared for sale — a lollipop with the image of the symbols of the city on a circle with the colors of the state flag of the Russian Federation. We are obliged to point out that the state flag of the Russian Federation and the state emblem are official state symbols. The rules for their use are strictly regulatedsays the experts’ letter.
According to the chairman of the Sevastopol Heraldic Society “Heraclea” Yuri Zhemoido and international expert on the theoretical foundations of symbolism Mikhail Bakanov, the use of such candy in public places contributes to the cultivation of disrespect for state symbols. Especially if you imagine a picture of people walking down the street licking such candy.
However, apparently, the lollipops are not particularly popular — no mass sales have been observed. But members of the Heraldic Commission, in their open letter, draw attention to the city’s careless attitude towards symbolism in general. This applies to the coat of arms and flag of Sevastopol, as well as the register of symbols, emblems and logos of city services and enterprises, which simply does not exist.
The basic requirements for the design and registration of city symbols have not been met — the coat of arms and flag have not passed the examination of the Heraldic Council under the President of the Russian Federation, which is mandatory for inclusion in the State Register, the letter says.
Experts propose to restore order in the city in the field of heraldry, since “a similar state of affairs in Sevastopol in the field of symbols, called the patriotic capital of Russia, is simply unacceptable.”
According to Y. Zhemoido and M. Bakanov, it is necessary to create a Heraldic Council with status under the Legislative Assembly or the Public Chamber. To systematize the symbolic space of Sevastopol and propose options for its replenishment and protection, create a city heraldic register, clarify the issue of the right to use the coat of arms and develop regulations for the right to use the city’s symbols.
But so far, according to the authors of the letter, their appeals have not received adequate support or understanding from local governments and state authorities.
There were precedents
By the way, questions about whether it is possible to use state symbols in confectionery products periodically arise in different regions. For example, a bakery in Kaliningrad decided to decorate cakes with the Russian flag for February 23rd. The lawyers said that this could be done and quoted the law: “The use of the State Flag of the Russian Federation, including its image, by citizens, public associations, enterprises, institutions and organizations in other cases is permitted, if such use does not constitute an outrage on the State Flag of the Russian Federation «
In principle, the legislation does not contain a formal ban on the use of the image of the Russian flag on the labels of any industrial products, including alcohol. In general, there is no law enforcement practice that would regard such placement as abuse. But the nuances are still important, and apparently what kind of confectionery product the symbolism is applied to also needs to be taken into account.
