The Legislative Assembly of Canct Petersburg is going to make such an offer to the State Duma. If necessary, such objects on private lands can be demolished without trial and investigation.
Residents of the city complain of a large number of non -stationary trading facilities near multi -storey buildings. At the same time, the site near the house is in private ownership, it is included in the common property of an apartment building.
Now in state plots, non -stationary trading facilities can be placed through competitive procedures, in accordance with the city scheme. These requirements do not apply to private land. To install a kiosk on a private site, the owner’s consent is enough. Deputies believe that this creates inconvenience for local residents.
In the case of land near an apartment building, residents are made on the installation of a kiosk or car wash, the head of the Housing and Public Utilities of the Housing and Public Utilities in St. Petersburg Alla Bredets notes. Owners of apartments receive income from the placement of a trading facility, so they do not want them to be removed from such decisions, the expert emphasizes. There are no clear criteria in the draft law according to which the authorities can refuse to place a kiosk. In addition, it is unclear what will happen to objects that already work and do not cause complaints among the townspeople.
Deputy of the Legislative Assembly Irina Ivanova clarified that it is not only about house plots. According to the bill, a roadside car wash, which is not included in the city scheme, can be demolished without a court decision. She noted that land plots are sold at auction for a lot of money. There is a risk that the entrepreneur will buy land, but will not be able to do anything on the site.
All non -stationary objects should not be combed under one comb, says Yanin Grishin, chairman of the regional public organization “Promoting Small Business”. Now residents of high -rise buildings own the land near the house. They can rent a site and earn on this.
The chairman of the Committee for Legal Support for the Business of the Rostov Regional Branch of the Russian Federation Inna Cheserkina believes that the amendments are jealous of the principles of private property. If tenants are obliged to coordinate decisions with the city administration, the municipality will actually be managed by private land. This can lead to abuse, especially in terms of demolition of objects. Small and medium -sized businesses will be depending on the decisions of local officials. According to the expert, an alternative can be a flexible regulation mechanism. It is necessary to develop clear urban planning standards for private land plots, without mandatory coordination with local officials.
