The appeal courts introduced to the Code of Civil Procedure of the Russian Federation are transmitted by the authority to resolve issues of acceptability of appeals. Submit an appeal, as before, is necessary through a court that made a decision.
The following innovations are also provided:
- An application for the restoration of a missed procedural period will need to be submitted to the court of appeal. Simultaneously with the submission of the application, the necessary procedural action must be made (a complaint was submitted, documents are submitted) in respect of which the deadline has been missed;
- The court will consider this statement within a five -day period from the date of its receipt without a court session and without notifying the persons participating in the case;
- Before the expiration of the appeal of the person participating in the case, it is entitled to submit objections to the appeal to the court of first instance, and after the expiration of the appeal — to the court of appeal;
- It will not be possible to appeal the definition of the restoration of the missed procedural deadline for filing an appeal. The determination of the refusal to restore the missed procedural period can be appealed to the cassation court of general jurisdiction, the cassation military court.
Other changes have been made.
