In Alushta, Goskomregister inspectors identified a house with an “extra” floor

An object being built with violations on Sergeev-Tsensky Street came to the attention of employees of the State Committee for State Registration and Cadastre of the Republic of Crimea. During the inspection visit, specialists established that a concrete building was being erected on a plot of land with an area of ​​450 square meters, granted ownership to an individual for individual housing construction. However, based on external signs, state land inspectors had questions about the legality of construction.

In accordance with current legislation, on a land plot allocated for individual housing construction, it is allowed to build an individual residential building with no more than 3 above-ground floors. Exceeding the number of storeys of the facility entailed a violation of the norms of urban planning and land legislation. For the use of a land plot not for its intended purpose, liability is established as provided for in Part 1 of Article 8.8 of the Code of Administrative Offenses of the Russian Federation. The owner of the site has already been issued an order to eliminate the violation of the requirements of land legislation, and also faces an administrative fine– the press service quotes the deputy chairman of the State Registration Committee, the deputy chief state inspector of Crimea for the use and protection of lands, Konstantin Titkov.

In addition, other response measures were taken regarding this unfinished project. Thus, based on the results of control and supervisory activities, Goskomregister compiled and sent to the administration of Alushta a notification about the identification of unauthorized construction. After reviewing the materials in the municipality, a decision was made to file a lawsuit to demolish the unauthorized building or bring it into compliance with established requirements.

Landowners and land users should not forget that the law establishes cases for applying administrative measures to violators. Goszemnadzor has the right to conduct unscheduled supervisory inspections and for neglect of the law, as this case shows, owners will have to bear responsibility, — emphasizes Konstantin Titkov.
